When is an employer vicariously liable for the actions of its employees?

In two recent cases, the Supreme Court has considered the test for vicarious liability in employment and employment-like relationships to determine when an employer is liable for the acts of its employees.

In Mohamud v WM Morrison Supermarkets plc, a customer had been subjected to a serious assault and racial abuse by the employee in his working hours and on company premises. The customer brought a claim in the County Court against Morrison’s which they contested, arguing that their employee was not acting on their behalf when the customer was assaulted. However, the Supreme Court disagreed.

Domestic Abuse in BME communities Meeting

BME Health Forum  warmly invites you to their  next quarterly meeting on Domestic Abuse among BME Communities on the 25th May 10-1 at Greenside Community Centre, 24 Lilestone Street, London NW8 8SR.

We will explore the issue of Domestic Abuse from many different angles such as the barriers around housing, the particular difficulties for people with no recourse to public funds and the psychological issues for young people who have been exploited for domestic servitude. We have confirmed presenters from Al Hasaniya, African Women’s Care, Afruca, Justice for Domestic Workers and Standing Together. At the end of the meeting there will be an opportunity for delegates to give feedback to commissioners and providers about what we think the key issues are on this complex topic.

A hot and delicious lunch will be served at 12.30

Everyone is welcome.

We are writing to seek your help in recruiting a panel of young people to design and deliver new ways for young people to have their say on decisions about the services and activities on offer in Hammersmith & Fulham and inform the discussions taking place by the newly established Partnership for Young People.

I attach a flyer which provides some more information about the new young people’s panel and details on how to sign up We have set up an event on Eventbrite for young people to register with – the link is as follows: http://hfpartnershipforyoungpeople-youthvoicepanel1.eventbrite.co.uk

Details will also be posted on the “H&F Youth Involved” Facebook page and, once up and running, on the LBHF internet webpage.

Please do feel free to share the flyer and reference the Event Brite link in your communications. We have just two weeks to recruit a panel of approx 8 – 20 individuals with the first session on 10 May.

In addition, by the end of May, we hope to have a short film and questionnaire, developed by the new young people’s panel, to send out. We would very much appreciate your help in ensuring the young people that attend your project(s) get their opportunity to have their say by watching the film and completing the questionnaire. We’ll be in touch with more details once the young person’s panel is formed.

Please help with research into the use of data by the sector

Charities and social enterprises in our area are being asked to take part in a research project into the use of data by organisations in the sector. You can help by answering a few simple questions online http://bit.ly/dataevolution .

The research is part of the Data Evolution project being run by the charity DataKind UK and the social enterprise Data Orchard.

The two organisations are trying to work out the challenges and opportunities different sorts of charities and social enterprises face to making better use of data.

They hope that this will mean that it will be possible to provide better advice, signposting and support to organisations at different stages of their use of data.

Emma Prest from DataKind UK explained:

“At DataKind we have seen first hand how transformative the smart use of data can be for charities. Data-driven decision making can save organisations money and increase impact. We want to understand how we can better support the social sector as they progress along their data journeys.”

Sian Basker from Data Orchard CIC added

“The results of this research could have far-reaching impacts on the effectiveness of the sector”

“We need to hear from the charities that haven’t considered what data might mean for them as much as those that are making lots of use of analytics. There are no right or wrong answers”.

You can sign up to be sent a reminder when the survey goes live. Just visit http://bit.ly/dataevolution

More information about the project is available at the project website http://dataevolution.org.uk/ or info@dataorchard.co.uk

Your help needed towards a CAMHS redesign in Tri-Borough

The Anna Freud Centre has recently been commissioned by the North West London Clinical and Commissioning Group (CCG) Collaborative to carry out a needs assessment and service mapping in relation to children and young people’s mental health and wellbeing. This will inform a CAMHS redesign in Brent, Ealing, Harrow, Hillingdon, Hounslow and Tri-Borough (Westminster, Hammersmith & Fulham, and Kensington & Chelsea). Please see the below letter from the North West London Collaboration of CCGs’ Strategy and Transformation Team.

It is vital that any service changes are made based on a comprehensive knowledge of what is being done now.

Therefore we are asking all local organisations which work with children and young people, parents, carers and families to complete the following surveys. Please distribute these links to the relevant members of your team:

  1. To be completed by a member of the senior management team. This survey asks questions about the service provided by your organisation, and the workforce you employ. For more information and to complete the survey, click here: https://www.surveymonkey.co.uk/r/NWL_7
  1. To be completed by all other members of staff, particularly those who provide training. This survey asks questions about your role in the organisation, any training you have provided, and training you have received. For more information and to complete the survey, click here: https://www.surveymonkey.co.uk/r/NWL_Training7

We would like to thank you in advance for your support. And of course we are keen to hear your views too. Your help in completing both of these surveys is crucial.

If you have any questions, please do not hesitate to get in touch with (Nuno Nodin, Research Manager, Nuno.Nodin@annafreud.org, 020 7443 2983; Jeni Page, Project Manager, Jeni.Page@annafreud.org, 020 7443 2221)
